Description of Service
Provision of custom garments to the specifications and measurements received from you (the “client”) during your consultation.
Refund/Cancellation
Because of the incredibly unique nature of custom garments, we do not offer refunds on our custom garments or provide for cancellation after payment. We are here to build the garment designed down to your ordered specifications and details, which makes each custom garment a unique good not fit for inventory or ‘resale.’ A part of that is requiring a commitment from you that you are fully invested in the custom garments and have carefully reviewed and selected each detail. When refunds are an option, you can have “one foot in” the work, and “one foot out” the door. It is to *your* benefit to decide *before* purchasing your custom garments and committing to work with us that we are the right custom garment provider for you. If you’re in, you need to be 100% in, just as we will be for you.
Should you need to change any details, measurements or other notes, please reach out immediately with your request, but we cannot guarantee that any changes can be made based on the nature of construction and assembly of a custom garment.
Delivery Timing
Because of the nature and art of designing custom garments, your timely pickup of your custom garments when they are ready is paramount. When your garments are ready for delivery and fit, we will announce same to our last point of contact with you. You will have 15 calendar days to pick up your garments, after which time any alterations, regardless of the reason for same, will become solely the client’s responsibility. If 30 days have passed, any non-material discrepancies between the finished custom garments and the details specified by the client become the client’s responsibility. After 90 days, we reserve the right to dispose of the garment and/or charge a fee for storage of said garment thereafter, and the client will have no rights to refund as a result of any such disposal or charge.
Further, given the unique nature of the process of manufacturing custom garments, all delivery timing estimates given (whether oral or in writing) with respect to our delivery of the custom garments to you are only estimates and shall not be deadlines, outside delivery dates, or other contractual or equitable obligations to the client. Timing may and often does vary widely.
Force Majeure
CLTheBrand Consulting LLC shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other labor disputes, riots, pandemic, epidemic, earthquakes, floods, explosions or other acts of nature. Any additional or changing requests from the client and/or issues caused by the client shall additionally extend all timeframes relative to CLTheBrand Consulting LLC’s obligations.
Limitation of Liability
The Client acknowledges and agrees that CLTheBrand Consulting, LLC, and its owners, directors, members, contractors, successors and/or assigns, will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the client has been advised or otherwise might have anticipated the possibility of such loss or damage.
No Guarantee
The client acknowledges and agrees that CLTheBrand Consulting, LLC cannot guarantee the results or effectiveness of any of the services rendered or to be rendered or goods delivered or to be delivered. Services shall be executed and goods shall be delivered in accordance with good industry practice. Without limiting the foregoing, the client expressly acknowledges and assumes the risk of any change in body measurements which may occur between the initial measurement of the client by us and ultimate delivery of the custom garments.
The client agrees to execute a Delivery Receipt immediately upon and as a condition to our delivery of any goods. Any failure or refusal by the client to execute the Delivery Receipt, subject to any failure by us to deliver the garments ordered, shall automatically result in a waiver of all claims, include any claim of refund, for any missing items or material differences between your ordered specifications and measurements and the goods delivered.
Media Release
The client grants permission to CLTheBrand Consulting LLC to use the client’s image (including without limitation photographs and/or video) for use in media publications of all kinds. The client waives any right to inspect or approve the finished photographs or electronic matter that may be used in conjunction with same now or in the future, whether such use is known or unknown to the client, and waives any right to royalties or other compensation arising from or related to such use.
